GENERAL TERMS AND CONDITIONS OF SALE
Article 1. Preamble
Any use of the premises made available under the commercial name "STUDIO SHAPES PARIS" implies formal acceptance without exception or reservation, by the client or any person representing them, of these general terms and conditions of sale. The client declares to have had them in their possession and to have taken note of them, and they are also available at any time on the Studio Shapes Paris website at the address www.shapes.paris. It is understood that acceptance by the client of a quote, the placing of a dated and signed order, the payment of a deposit, or the start of performance of a service implies acceptance of these terms.
Article 2. Rental Conditions and Operation of the Premises
The client agrees to provide the company responsible for the marketing of "STUDIO SHAPES PARIS" with a call sheet prior to each service, stating the names and roles of the people present on the rented set. Consequently, these individuals will be deemed authorized by the Client to incur any expenses with the company "STUDIO SHAPES PARIS". However, the Client may formally designate a single person to the company "STUDIO SHAPES PARIS" authorized to incur expenses on their behalf. In the absence of a call sheet or designated person, all individuals present on the set will be considered mandated by the Client.
Any service performed by "STUDIO SHAPES PARIS" will give rise to the establishment of a production sheet and/or the corresponding quote detailing the materials and services requested by the Client by the Studio Shapes Paris teams. The production sheet and/or quote serves as the basis for the final billing post-rental. Additionally, for each service, an expense report will be completed by the production assistant. This report will attest to the expenses incurred by "STUDIO SHAPES PARIS" on behalf of the Client.
The Studio Shapes Paris is billed for a half-day for a duration of 5 hours, from 9 am to 2 pm or from 2 pm to 7 pm, or for a full day for a duration of 10 hours, from 9 am to 7 pm. Before 9 am and after 7 pm, the occupation time will be charged as overtime, in increments of 1 hour. In accordance with the collective agreement "for technical companies serving creation and events" applicable to the personnel of the company "STUDIO SHAPES PARIS", any service lasting more than 14 hours must be scheduled at least 4 hours in advance and must be subject to a specific quote.
All our quotes have a validity period of 7 days and become void if not returned signed and stamped with the mention "good for agreement" within 7 days before the start date of the service. Any order canceled less than 96 hours before the start of the service will be fully billed. Any equipment or accessory not retrieved within 48 hours following the end of the service will result in the Client paying a daily storage fee calculated based on the volume stored. Items not recovered by the Client within a period of 7 calendar days will be thrown away and will incur additional billing.
For security reasons, it is reminded that the Client is responsible for the couriers they call upon. Consequently, they undertake to drop off and receive their mail themselves with the couriers they mandate. In the absence of the Client, the visa affixed by the company "STUDIO SHAPES PARIS" on letters or delivery slips does not engage their liability or that of their teams and serves only to confirm the passage of the delivery personnel regarding their company and does not constitute a receipt nor acceptance of the merchandise.
Article 3. Recourse, Responsibilities, and Insurance
The "STUDIO SHAPES PARIS" commits to providing the Client with premises, equipment, and materials in perfect working order. The Client agrees to return them in the same condition. Otherwise, repair and restoration costs will be charged to the Client with presentation of the quote or invoice from the competent service provider for each repair. The Client is responsible for any person present at the service location and for the consequences of their actions. The Client agrees to take all necessary security measures for valuable items they bring into the premises of "STUDIO SHAPES PARIS". They undertake to inform the teams and/or responsible persons of "STUDIO SHAPES PARIS" in advance.
"STUDIO SHAPES PARIS" cannot be held responsible for any personal injury, material or immaterial damage occurring on the premises, as well as for any theft, deterioration, or damage of any kind that may occur to cash, materials, clothing, or any other goods, including animals, brought or delivered by the Client, their representative, or their agents. Consequently, it is the Client's responsibility to contract the necessary insurance to cover all the risks mentioned above. They commit to presenting the corresponding certificate at the first request of "STUDIO SHAPES PARIS".
Article 4. Files and Digital Services
The "STUDIO SHAPES PARIS" cannot be held responsible for the loss or degradation of images or data used by the Client or obtained through the equipment made available to them. In the event of any wrongdoing attributable to "STUDIO SHAPES PARIS," its liability cannot be engaged beyond the provision of the same technical means that were made available to the Client to allow them to reconstruct the lost or damaged data.
Article 5. Payment Conditions and Deadlines
All services are payable as follows:
– 30% deposit upon confirmation of the order
– Balance, i.e. 70%, 48 hours before the service day
– Additional services not quoted payable on the same day by credit card (3% fee), bank transfer, or in cash upon receipt of the invoice.
No discount will be granted.
The "STUDIO SHAPES PARIS" reserves the right to include in its quotes an amount corresponding to a provision for meal expenses and additional costs. It is understood that the corresponding invoice will only state the actual expenses incurred by the Client, justified by the production sheet and the expense report. In the event that the advances received exceed the amount of the invoice, "STUDIO SHAPES PARIS" commits to refunding the difference within a period of 15 calendar days.
If a bill is not paid by its due date, a late fee will automatically and without prior notice be due from the first day following the due date, calculated at three times the legal interest rate in France. Furthermore, all other invoices issued to the same Client, even if not due, will be immediately payable as well as all future payments related to one or more invoices. The Client agrees to reimburse all costs and fees incurred by the contentious recovery of the amounts due, including costs, fees, and/or emoluments of ministerial officers.
Article 6. Disputes
In the event of an incident or technical dispute, the client must state their observations in writing within 24 hours of the service date (postmark providing proof).
